Terms of Service

Welcome to Snootit. These Terms of Service (“Terms”) govern your access to and use of the Snootit website (snootit.com), mobile applications, QR smart pet tags, biometric pet identification services, digital pet profiles, pet recovery features, and all related products and services (collectively, the “Services”) operated by Snootit, Inc. (“Snootit,” “we,” “us,” or “our”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services. These Terms constitute a legally binding agreement between you and Snootit, Inc.

1. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to create an account and use Snootit's Services. By using our Services, you represent and warrant that you meet these requirements and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organization (e.g., a veterinary practice, shelter, or rescue), you represent that you have the authority to bind that organization to these Terms.

2. Account Registration

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must immediately notify us at support@snootit.com of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these Terms or are associated with fraudulent activity

3. Pet Profiles and Digital Identity

3.1 Pet Profile Creation

When you create a pet profile on Snootit, you represent that you are the legal guardian or authorized caretaker of the pet. You agree to provide accurate information about your pet, including breed, age, distinguishing features, and relevant health information.

3.2 Identity vs. Ownership

Creating a Snootit Digital ID does not establish legal ownership of a pet. Snootit is an identity and safety platform, not a legal authority. A pet's digital identity is permanent and independent - it exists even if guardianship changes. Disputes regarding pet ownership must be resolved through appropriate legal channels.

3.3 Biometric Enrollment

By using our biometric pet identification features (dog nose print recognition and cat facial recognition), you consent to the collection and processing of your pet's biometric data as described in our Privacy Policy. Biometric enrollment is voluntary and provided as a supplementary identification layer. Biometric data is used solely for pet identification purposes and is never sold or shared with third parties for commercial purposes.

4. QR Smart Tags - Purchase and Use

4.1 Product Description

Snootit QR smart pet tags are physical, wearable tags that link to your pet's digital profile when scanned with any smartphone. Tags are designed for durability but are not indestructible. Normal wear and tear may affect tag readability over time.

4.2 Pricing and Payment

All prices are listed in US Dollars (USD) and are subject to change without notice. Applicable taxes and shipping fees will be calculated at checkout. Payment is processed securely through Stripe. We accept major credit cards, debit cards, and other payment methods supported by Stripe.

4.3 Shipping and Delivery

• Standard Shipping: 5-7 business days within the United States. Free on orders over $50
• Expedited Shipping: 2-3 business days within the United States
• Processing Time: Orders placed before 2:00 PM EST on business days typically ship the same day. Custom-engraved tags may require 1-2 additional business days
• Shipping Carrier: We use USPS, UPS, or FedEx at our discretion. Tracking information is provided via email for all orders
• International Shipping: Currently not available. We ship to all 50 US states and US territories
• Lost or Damaged Shipments: If your package is lost or arrives damaged, contact support@snootit.com within 14 days of the expected delivery date for a replacement or refund

4.4 Returns and Refunds

• We offer a 30-day satisfaction guarantee on all Snootit QR smart pet tags
• To initiate a return, contact support@snootit.com within 30 days of delivery
• Tags must be in original, unused condition for a full refund
• Custom-engraved tags are non-refundable unless defective
• Refunds are processed to the original payment method within 5-10 business days
• Return shipping costs are the responsibility of the buyer unless the item is defective or an error was made on our part

4.5 Product Warranty

Snootit QR smart tags come with a 1-year limited warranty against manufacturing defects. This warranty does not cover damage from misuse, neglect, normal wear and tear, or exposure to extreme conditions. To file a warranty claim, email support@snootit.com with your order number and photos of the defective product.

5. Free and Paid Services

5.1 Free Services

The following features are and will always remain free:

• Digital pet profile creation
• Biometric pet ID enrollment (dog nose print and cat facial recognition)
• Lost Mode activation and alerts
• Recovery Room - anonymous, secure communication between finders and guardians
• QR tag scanning and basic profile viewing

Safety is never paywalled. We will never charge a fee for features critical to a pet's safety.

5.2 Paid Services

Premium features, subscription plans, and physical products (QR smart tags, accessories) may be offered at additional cost. Pricing and terms for paid features will be clearly disclosed before purchase.

6. Pet Recovery and Lost Mode

Snootit provides tools to aid in pet recovery, including Lost Mode alerts, QR tag scanning, and the Recovery Room. However:

• Snootit does not guarantee the recovery of any lost pet
• The Recovery Room facilitates anonymous, secure communication between finders and guardians. We are not responsible for the actions of any third party
• Lost Mode notifications rely on community participation and are not a substitute for contacting local animal control, shelters, or law enforcement
• Our goal is safe reunion, not confrontation. Aggressive or threatening behavior through the Recovery Room may result in account suspension

7. User Conduct

You agree not to:

• Use the Services for any unlawful purpose
• Create fraudulent pet profiles or misrepresent guardianship
• Interfere with or disrupt the Services, servers, or networks
• Attempt to reverse-engineer, decompile, or extract source code from our software
• Scrape, harvest, or collect data from the Services without authorization
• Upload malicious code, viruses, or harmful material
• Harass, threaten, or abuse other users through the Recovery Room or any other feature
• Use the Services to facilitate animal abuse, neglect, or trafficking
• Circumvent any security measures or access restrictions

8. Intellectual Property

All content, features, functionality, trademarks, logos, and service marks displayed on Snootit are owned by or licensed to Snootit, Inc. This includes but is not limited to text, graphics, images, videos, software, algorithms, AI models, and the overall look and feel of the Services. You may not copy, modify, distribute, sell, or lease any part of our Services or included software without our written permission. The Snootit name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Snootit, Inc.

9. User Content

By uploading content to Snootit (including pet photos, profile information, and biometric data), you grant Snootit a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of providing and improving the Services. You retain all ownership rights in your content. You represent that you have all necessary rights to upload and share such content.

10. Disclaimers and Limitation of Liability

10.1 Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SNOOTIT DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SNOOTIT, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10.3 Pet Safety Disclaimer

Snootit is a supplementary pet identification and safety tool. It is not a substitute for responsible pet ownership, proper supervision, secure fencing, leash laws, or microchipping as required by local regulations. Snootit does not guarantee the prevention of pet loss or the successful recovery of lost pets.

11. Indemnification

You agree to indemnify, defend, and hold harmless Snootit, Inc. and its affiliates, officers, directors, employees, and agents from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services ceases immediately. You may terminate your account at any time by contacting support@snootit.com. Upon account termination, your pet's digital profile will be deactivated, but biometric data will be retained for 90 days before deletion to allow for account recovery. QR tags linked to a deleted account will display a message directing finders to contact Snootit for assistance.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email and/or by posting a notice on our website at least 30 days before the changes take effect. Your continued use of the Services after the effective date of revised Terms constitutes your acceptance of the changes.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Snootit, Inc. regarding the use of the Services and supersede all prior agreements, representations, and understandings.
